Yogurty’s – froyo®Nation Rewards Program

Terms of Service (hereinafter referred to as TOS)

1. Earn froyo®Nation Points

a. The Yogurty’s froyo®Nation Rewards Program is powered by Unoapp and uses our froyo®Nation Gift + reward card – or a digital Gift + reward card within our mobile smartphone app for iOS and Android – which is a combined gift and rewards card in one. Use of the card as a gift card or rewards card does not require use of the other functionality.

b. The Yogurty’s froyo®Nation Rewards Program is subject to these terms and conditions along with those of Unoapp — available at http://www.unoapp.com/privacy-policy/— and may also be subject to the terms of use of our other service providers.

c. Your Yogurty’s Gift + reward card tracks froyo®Nation points (points) to be applied to the Yogurty’s froyo®Nation account to which the card is registered.

d. We may use data collected from such use for the purpose of developing marketing initiatives, programs, administering this program and other such use as we may deem appropriate.

e. We shall not share or divulge your personal account information except to the extent required by law or as required for the purpose of administering this program.

f. Your Yogurty’s Gift + reward card may be used as a gift or rewards card at participating Yogurty’s locations only, in the country in which it was obtained.

g. One Point will be awarded for each cent ($0.01) spent (pre-tax, after applicable discounts, including deal site vouchers and/or other approved third-party offers) when you make purchases of product (excluding the purchase of gift cards and parties) at participating Yogurty’s locations only.

h. Your Yogurty’s froyo®Nation account will reflect whole points you have earned. For example if your purchase is $4.23, you get 423 points.

i. You must present your froyo®Nation card or app at time of purchase to have points credited to your Yogurty’s froyo®Nation account .

j. In the event you do not have your card at time of purchase, you may be able to provide your email address to the cashier and they will look up your account, at those locations that allow for this. Where this is not available at a location, you may email us a clear, unaltered scan of your receipt tomarketing@yogurtysfroyo.comand we will credit your account the number of points that your receipt indicates you could have earned, provided the transaction has not been previously submitted and its points credited to any other froyo®Nation account.

k. You must register your account to get 500 bonus points. Register by visitinghttp://www.yogurtys.com/froyonationor by creating an account through the app.

l. points on multiple froyo®Nation accounts cannot be combined except in special circumstances, which may include but are not limited to: family accounts, team accounts, fundraising programs. Please check with your store manager, or contact Yogurty’s corporate head office (info@yogurtys.com) for more information.

m. Froyo®Nation points may not be used in conjunction with any other offer nor may they be earned on coupon or voucher purchases.

2. points Rewards and Redemption Structure

a. 1 cent spent = 1 point earned ($1 spent = 100 points earned)

b. $1 spent = earns 100; 5,000 points = 1 free treat “$5 off”;

c. 500 sign-up bonus — first time and card only;

d. 5,000 birthday bonus points awarded once per calendar year for those customers who have provided their birthday and who have made at least 2 purchases at a Yogurty’s location in the last 12 months;

e. Managers can award bonus points at the POS to make up for customer service issues in store;

f. Bonus points may be awarded as part of a seasonal or other type of promo.

g. Earn one (1) froyo®Nation Point for each cent ($0.01) spent (pre-tax, after applicable discounts, including deal site vouchers and/or other approved third-party programs) when you make purchases of product (excluding the purchase of gift cards and parties) at participating Yogurty’s locations only. Check your receipt to see how many froyo®Nation points you have earned or visit our website and navigate to the froyo®Nation section.

h. You can earn a maximum of 50,000 points froyo®Nation points per day. Other restrictions may apply.

i. Your froyo®Nation points may not be used on the same transaction from which they are earned, and are only valid on subsequent visits. froyo®Nation points continue to accrue in your froyo®Nation account until they are spent and do not expire, except where required by law or if we cancel/discontinue the froyo®Nation Rewards program.

j. To redeem eligible froyo®Nation Points, present your froyo®Nation card or app to the Yogurty’s cashier for redemption when making a purchase. froyo®Nation points in your froyo®Nation Account will be applied toward your purchase as a discount, and you shall be responsible to pay any remaining balance due. Your froyo®Nation points will decline by the amount redeemed toward your purchase.

k. froyo®Nation card points or froyo®Nation points have no cash value and may not be redeemed for cash.

l. froyo®Nation points are valid at participating Yogurty’s locations only and have no expiration date, unless otherwise stated on any promotional offer, the program is changed and points expiration is introduced, or where required by law.

m. Yogurty’s is not responsible for lost, stolen, or damaged froyo®Nation cards, or lost or stolen points. Yogurty’s is not responsible for any unauthorized card use.

n. Yogurty’s reserves the right to change or modify this program at any time, without notice.

o. froyo®Nation points redemptions cannot be combined with any other discounts or offers, unless specified otherwise.

3. froyo®Nation Bonus Points

a. Yogurty’s may award bonus points from time to time, to any user, at its sole discretion. Bonus points may include but are not limited to: birthday points, registration anniversary dates, in consideration of customer service issues, new customer referrals and for other purposes which may be determined at some future date.

b. Bonus points for new customer registrations, new customer referrals, facebook posts and twitter posts, can be viewed on the Yogurty’s websites.

c. 5,000 birthday bonus points will be awarded the day of a user’s birthday provided that the user has supplied their birthday within their account profile.

d. Any failure on our part to award points of any kind shall only require us to credit the user’s account with the actual points not awarded and no further.

4. General

a. Participant will indemnify and hold harmless Yogurty’s for any damages arising from unlawful use of the froyo®Nation card or participation in the Program, including identity theft.

b. To the full extent permitted by law, Yogurty’s shall not be liable for any special, indirect, punitive or consequential damages arising from use of the froyo®Nation card or participation in the Program. In any event, Yogurty’s and its affiliates’ liability shall be limited to the greater of $50 and the redemption value of points accumulated in a claimant’s froyo®Nation card account.

c. To the full extent permitted by law, Yogurty’s and its affiliates disclaim any warranties that may associated with use of the froyo®Nation card or participation in the Program. User’s sole remedy shall be termination of his or her account and redemption of accrued points.

d. These TOS are to be governed by and construed in accordance with the laws of the Province of Ontario, Canada.

e. These TOS constitute the entire agreement between the parties and supersede any prior or contemporaneous understandings, whether oral or in writing.

f. Waiver of any provision of the TOS is only effective if in writing and signed by an authorized representative of Yogen Früz.

g. With respect to any user of the froyo®Nation card or participant in the Program, the provisions of these TOS shall prevail in the event of any conflict with other service provider’s TOS.

h. Use of the froyo®Nation website or Yogurty’s gift + reward card (froyo®Nation) card, either as a gift card, rewards card or both, constitutes agreement with and acceptance of these and all other related terms and conditions.
